Okay, here are my thoughts on this. Ruina did use the image as a reference for her profile picture. I also did some good ol’ research and found some insteresting things about digital art and copyright.

First of all, and I state, “All art is copyrighted from the moment it is produced or becomes a fixed copy.” This means any sort of art through any medium is copyrighted from the moment it is produced. Fixed in a copy can mean the display of the artwork on a monitor, in the case of digital art. All forms of art are copyrighted, even with the exclusion of the copyright symbol, “©”.

Let’s learn more about copyright laws, shall we? Copyright laws generally falls under “civil law”, meaning the artist would have to initiate a law suit to protect their rights. In severe cases, copyright can fall under “criminal law”, which is a much more serious felony.

The third thing we should all be aware about is derivative work. ‘Derivative work’ is a piece of work influenced by one or more preexisting works. Reference material can fall under this category. The article states, “Copyright law supports the making of derivative works, but only by, or through the permission, of the copyright owner.” This means it would be uncivil for one to reference a piece of work without the owner’s consent. Ruina’s profile picture would fall under ‘derivative work’. Unless she has received permission from the original artist, Ayamy, Ruina has technically broken copyright law.

In the end, does this mean anything? No, Ruina isn’t going to get sued anytime soon. Does that make it right? No, as Ruina gets more recognition and begins to earn money off her work, it will most certainly be considered illegal. Since she only used the image as a reference for personal use, I don’t think she’s breaking any major laws. Ruina is an aspiring artist and criticism will only help her grow. In my opinion, the use of direct reference is a bit unsettling but I think everyone can live with it. I support both her and her art, and hope to see more original pieces from her.

I dont mind this thread at all. All I wanted is to inspired people by my work. I did some copyrighted pictures Like the dutchie groups bcuz iM still working for the dutch angel drawings. I wont quit. I still stay here. Brokenlens is my home so I wont quit just for arts. If some people dont like me then its fine. I dont care what they say. All I wanted is to be happy and make people happy. Thats what I do
I'm gonna start inspiring people by colouring in pictures in my colouring book. You know, when you take the outline of a picture and then colour it in to whatever you want?
Then, i'll tell them to bow down to me, the God of drawings.
