In the books he uses a torch to do homework

I just reread the books he uses his wand, he also uses Lumos at the Quiddich world cup.

I was kind of thinking PoA when I saw that, so I guess later books he does and hermeh ar be stoopid. Quidditch World Cup doesn't really count though. The Ministry can't tell who's been using magic if there are a lot of wizards around, and it was a dangerous situation after so it's allowed

Actually its "no magic out of Hogwarts" so they can't expose their world with magic.

A young wizard/witch who spends summer in a Muggle community can't use magic without the Ministry instantly knowing and sending a letter.
